Terms of Service – Konzept Zeit

§1 Definitions

For the purposes of these Terms of Service, the following terms have the meanings specified:

  • "Store" or "We" or "Us": Konzept Zeit, a sole proprietorship ("Indywidualna działalność gospodarcza") operated by Radosław Michalski, registered in Poland with NIP 7741426977 and REGON 611366811.

  • "Website": The online store located at konzept-zeit.com and all associated web pages, services, and systems.

  • "Customer" or "You": Any individual or entity who visits the Website, creates an account, or purchases products from the Store.

  • "Product(s)": Luxury aluminium watch holders and related items offered for sale on the Website.

  • "Order": A customer's request to purchase one or more Products.

  • "Contract": The legally binding agreement between the Customer and the Store formed upon acceptance of an Order.

  • "Consumer": A natural person acting for purposes outside their professional or commercial activity (as defined under EU and Polish consumer protection law).

  • "Business Days": Weekdays (Monday–Friday), excluding Polish public holidays.

  • "Delivery Address": The address provided by the Customer for delivery of Products.

  • "EU": The European Union, including all member states.


§2 General Conditions

2.1 Scope and Applicability

These Terms of Service govern the relationship between the Store and Customers regarding the purchase and delivery of Products through our Website. By accessing our Website or placing an Order, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our Website or purchase Products.

2.3 Delivery Area

We deliver Products to customers located throughout the European Union (EU). Delivery is available to all EU member states and is subject to the payment and acceptance of these Terms. If delivery to a particular location is not available, we will notify you during the ordering process.

2.4 Pricing and Taxes

  • Price Display: All prices on our Website are displayed in EUR and are inclusive of value-added tax (VAT) at the applicable rate.
  • VAT Rates: VAT is calculated and applied in accordance with current EU tax regulations. The applicable VAT rate depends on the Customer's delivery address and is automatically calculated at checkout.
  • Delivery Costs: Shipping and delivery costs are clearly displayed and itemized separately from the Product price during the checkout process before final payment.
  • No Hidden Costs: We do not charge any hidden fees. You will see all costs—Product price, VAT, and delivery charges—before confirming your Order.
  • Currency: Prices are quoted in euros (EUR). If you view prices in another currency due to your browser settings, the transaction will be completed in EUR.

2.5 Availability of Products

Product availability is indicated on the Website. We reserve the right to:

  • Update product information, descriptions, images, and prices without notice
  • Limit quantities available for purchase
  • Discontinue any Product at any time
  • Refuse or cancel any Order if the Product is unavailable at the time of processing

If a Product ordered is unavailable, we will notify you as soon as possible and offer alternatives or a full refund at your choice.

2.6 Website Modifications

We reserve the right to modify the Website, its functionality, pricing, or policies at any time without prior notice. Your continued use of the Website after such changes constitutes your acceptance of the modified terms.


§3 Orders and Contract Formation

3.1 How to Place an Order

Orders are placed through our Shopify-based online store. To place an Order, you must:

  1. Select Products and add them to your shopping cart
  2. Review your Order and provide your delivery and billing addresses
  3. Select a shipping method
  4. Review the Order summary, including all costs
  5. Provide your email address
  6. Proceed to payment via Shopify Payments
  7. Complete payment authorization
  8. Confirm the Order

3.2 Order Confirmation and Contract Formation

  • Contract Formation: A binding Contract between you and the Store is formed only when:

    • You have completed the entire ordering process as described above
    • You have submitted your payment information via Shopify Payments
    • Payment has been successfully processed and authorized by your bank or payment provider
    • We have sent you a written order confirmation email containing:
      • Order number and date
      • Items ordered, quantities, and individual prices
      • Delivery address
      • Total amount charged (including VAT and shipping)
      • Your right of withdrawal (14-day return right)
  • No Contract Before Confirmation: Simply adding items to your cart or initiating the checkout process does not form a binding Contract. The Contract is only binding once you have received our email confirmation and payment has been successfully processed.

3.3 Order Acceptance and Rejection

We will review all Orders after receipt. We reserve the right to:

  • Accept or reject any Order, in our sole discretion
  • Cancel Orders that appear to involve fraud, unauthorized use, or violation of these Terms
  • Limit Orders to reasonable quantities

If we reject an Order, we will refund any payment received, typically within 5–10 business days. If we reject an Order, you will be notified by email at the address you provided.

3.4 Order Accuracy

Customers are responsible for ensuring that information provided during checkout (name, address, payment details) is accurate and complete. Incorrect or incomplete information may result in failed payment or delivery delays. We are not responsible for Orders delivered to incorrect addresses provided by the Customer.

3.5 Modifications and Cancellations Before Delivery

Once an Order has been confirmed, it cannot be modified or cancelled by the Customer through the Website. To request modifications or cancellations before shipment, please contact us immediately at zeit@werkkonzept.com. We will attempt to accommodate your request if the Order has not already been prepared for shipment. However, we cannot guarantee such requests will be honored. If a modification or cancellation is possible, any applicable charges or restocking fees will be deducted from your refund.


§4 Payment Terms

4.1 Payment Method

Payment for Orders is processed exclusively through Shopify Payments. Accepted payment methods include:

  • Credit and debit cards (Visa, Mastercard, American Express, and other internationally recognized card networks)
  • Digital payment methods available through Shopify Payments
  • Additional methods as displayed during checkout

We do not accept bank transfers, cash, or other payment methods.

4.2 Payment Processing

  • Authorization: By providing payment information, you authorize us to charge your payment method for the full Order amount (Product price + VAT + shipping).
  • Processing Time: Payment is processed immediately upon submission. Your bank or payment provider may take 1–3 business days to transfer funds to our account.
  • Failed Payments: If your payment is declined, we will attempt to notify you by email. You may retry payment or contact your payment provider for assistance.
  • Currency: All payments are processed in euros (EUR).

4.3 Shopify Payments

Shopify Payments is provided by Shopify Inc. and subject to Shopify's separate terms and privacy policies. For questions about your payment, billing, or refunds through Shopify Payments, please visit https://www.shopify.com/legal/terms or contact Shopify support.

4.4 Payment Security

We do not store complete credit card details on our servers. All sensitive payment information is transmitted securely to Shopify Payments using industry-standard encryption (TLS/SSL). Shopify Payments complies with PCI-DSS (Payment Card Industry Data Security Standard) requirements.

4.5 Receipt and Invoice

A receipt and tax invoice will be automatically generated and sent to your email address after successful payment. The invoice will contain:

  • Invoice number and date
  • Your name and delivery address
  • Itemized Product list with prices
  • VAT amount and applicable rate
  • Total amount paid
  • Our business details (name, address, NIP, REGON)

You may also access your receipts and invoices from your account dashboard on our Website.


§5 Delivery

5.1 Delivery Area and Costs

  • Coverage: We ship to all countries within the European Union.
  • Costs: Delivery costs are calculated based on the delivery address and the weight/size of your Order and are shown separately at checkout before payment.
  • Responsibility: The Store arranges and pays for shipping to the Delivery Address you provide. You are responsible for ensuring the Delivery Address is accurate and current.

5.2 Delivery Timeframe

  • Estimated Delivery: We aim to deliver Products within 5–15 business days of Order confirmation, depending on the destination country and shipping method selected.
  • No Guaranteed Deadline: We do not guarantee specific delivery dates. Estimated delivery times are approximate and non-binding.
  • Delays: We are not responsible for delivery delays caused by:
    • Customs or border procedures
    • Local postal or courier service delays
    • Weather conditions, natural disasters, or force majeure events
    • Incorrect Delivery Address information provided by the Customer
    • Recipient unavailability or refusal of delivery

5.3 Risk of Loss and Title

  • Transfer of Risk: The risk of loss, damage, or theft of Products transfers to you upon delivery to the Delivery Address. Once the package has been delivered (or attempted delivery has been made at your address), you assume all responsibility.
  • Proof of Delivery: We track all shipments. You can monitor your shipment status via your account or by contacting us with your Order number.
  • Lost or Damaged Shipments: If your Order arrives damaged or does not arrive within a reasonable timeframe, please contact us immediately at zeit@werkkonzept.com. We will investigate and attempt to resolve the issue, which may include filing a claim with the shipping carrier.

5.4 Recipient Signature and Delivery Attempts

Depending on the shipping method selected:

  • Some shipments may require a signature upon delivery
  • If delivery is attempted and you are not available, the courier will typically leave a notice with instructions for re-delivery or collection
  • You are responsible for arranging alternative delivery arrangements if necessary

5.5 Customs and Import Duties

For deliveries to certain EU countries, customers may be subject to customs duties or import taxes. These are the responsibility of the Customer and are not included in the stated price. You are solely responsible for any customs, duties, or import taxes assessed by local authorities.


§6 Right of Withdrawal (Consumer Right of Withdrawal)

6.1 Who Has the Right of Withdrawal

As a Consumer (a natural person not acting in a professional capacity), you have the right to withdraw from your Contract within 14 calendar days from the day the Product is delivered to you, without providing any reason and without incurring any penalty (except as noted below).

6.2 Withdrawal Period

The 14-day withdrawal period begins on the date the Product is delivered to the Delivery Address. The withdrawal period is extended if:

  • The delivery date is unclear—the period begins on the date you can confirm receipt
  • Multiple products are ordered—the period begins when the last product is delivered

To exercise your right of withdrawal, you must notify us in writing before the end of the 14-day period. Notification sent on the last day of the period is timely.

6.3 How to Exercise Your Right of Withdrawal

To withdraw from the Contract, you must send a written notice to us. Withdrawal may be communicated by:

  • Email: zeit@werkkonzept.com with the subject line "Withdrawal from Order [Order Number]"
  • Postal Mail: Send a written notice to:

    • ul. Synów Pułku 34, 09-410 Płock, Poland

Your withdrawal notice should include:

  • Your full name
  • Your Order number
  • The date you received the Product
  • A clear statement that you wish to withdraw from the Contract

6.4 Returning the Product

Once you have notified us of your withdrawal, you must return the Product to us within 30 days of sending your withdrawal notice. The Product must be:

  • Unused and Unmarked: In its original condition, unworn, and showing no signs of use
  • Complete: Accompanied by all original packaging, documentation, and accessories
  • Cost of Return: You must cover the cost of returning the Product to us. We do not reimburse return shipping costs.

We recommend using a tracked shipping method (such as registered mail or courier service) so you have proof of return. We are not responsible for Products lost in transit during return shipping.

6.5 Condition of Returned Products

Products returned in the following conditions will not be accepted for a refund:

  • Used or worn
  • Damaged or soiled
  • Missing original packaging or accessories
  • Showing signs of wear or deterioration
  • Returned after 30 days of sending withdrawal notice

6.6 Refunds

If we receive your returned Product in acceptable condition within 30 days of your withdrawal notice, we will issue a refund within 14 days of receiving the returned goods. The refund will include:

  • The Product purchase price
  • The original VAT amount

The refund will NOT include:

  • Original delivery/shipping costs (non-refundable)
  • Return shipping costs (your responsibility)

Refund Processing: Refunds will be issued to the original payment method used for the Order. Depending on your bank or payment provider, the refund may take 5–10 business days to appear in your account.

6.7 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Business customers or Businesses (non-Consumers)
  • Custom-made or personalized Products (if applicable)
  • Products delivered that are no longer in their original, unused, undamaged condition due to Customer handling

6.8 Effect of Withdrawal

If you withdraw from the Contract:

  • The Contract is cancelled
  • All performance obligations (delivery of Products) are cancelled
  • You must return the Product as described above
  • You are not entitled to compensation beyond your refund, except as provided in these Terms

§7 Warranty and Product Quality

7.1 Statutory Warranty

All Products sold by the Store are covered by the statutory warranty under Polish civil law and EU consumer protection regulations. Our Products come with a 2-year warranty period from the date of purchase.

7.2 Warranty Coverage

The warranty covers:

  • Defects in materials and workmanship present at the time of purchase
  • Failures that prevent the Product from functioning as intended
  • Defects that manifest within a reasonable time after purchase (typically within 6 months)

The warranty does not cover:

  • Normal wear and tear
  • Damage caused by misuse, neglect, or improper handling
  • Damage caused by accidents, drops, or impacts
  • Damage caused by unauthorized repair or modification
  • Cosmetic damage that does not affect functionality
  • Products damaged by water, humidity, or extreme temperatures
  • Fading or discoloration of materials over time

7.3 How to Make a Warranty Claim

If you believe your Product is defective:

  1. Contact Us: Email zeit@werkkonzept.com with:

    • Your Order number
    • Purchase date
    • Photos or detailed description of the defect
    • Explanation of when the defect appeared
  2. Evaluation: We will review your claim and may request additional information or photos.

  3. Resolution: If the claim is valid, we will offer:

    • Repair of the defective Product, or
    • Replacement with a new Product, or
    • Refund of the Product purchase price (minus original shipping costs)
  4. Return Process: We will provide instructions for safely returning the defective Product. Return shipping costs are covered by us for valid warranty claims.

7.4 Warranty Claim Response Time

We will respond to warranty claims within 14 business days of receipt. Processing the claim and arranging repair or replacement may take 4–8 weeks, depending on the nature of the defect.

7.5 Limitation of Liability

EXCEPT AS REQUIRED BY LAW, THE STORE DISCLAIMS ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. THE STORE'S LIABILITY FOR DEFECTIVE PRODUCTS IS LIMITED TO REPAIR, REPLACEMENT, OR REFUND AS DESCRIBED IN THIS SECTION.


§8 Complaints and Dispute Resolution

8.1 Complaint Procedure

If you are dissatisfied with your Order, the quality of the Products, or our service, you have the right to file a complaint.

To submit a complaint:

  2. Include:

    • Your full name and contact information
    • Your Order number
    • The date of your Order
    • A detailed description of the issue
    • Photos if applicable
    • What resolution you are requesting
  3. Timeline: Submit complaints as soon as possible after discovering the issue.

8.2 Our Response

We will acknowledge receipt of your complaint within 5 business days and will fully investigate your complaint. We will respond with our findings and proposed resolution within 14 calendar days of receiving your complaint.

8.3 Resolution Options

If we determine your complaint is valid, we may offer:

  • Repair or replacement of the Product
  • Refund (of Product price, or Product price minus return shipping)
  • Credit toward future purchases
  • Other remedy as deemed appropriate

8.4 Unresolved Complaints – EU Online Dispute Resolution

If you are a Consumer located in the EU and we cannot reach a mutually acceptable resolution within 30 days, you have the right to submit your complaint to an independent online dispute resolution platform.

EU Online Dispute Resolution Platform:

  • Usage: You can file a complaint free of charge through this platform, which will attempt to mediate between us and you.

To use the EU ODR platform:

  1. Visit https://ec.europa.eu/consumers/odr
  2. Select your country and enter your complaint details
  3. The platform will forward your complaint to us
  4. We will respond, and the platform will facilitate mediation
  5. If mediation is successful, the dispute is resolved. If not, you may pursue other legal remedies.

8.5 Consumer Rights in Your Country

As a Consumer in the EU, you also have consumer protection rights under your national laws. These terms do not limit any statutory consumer rights you may have. If any provision of these Terms conflicts with mandatory consumer protection laws in your country, those laws will apply.

8.6 Limitations on Complaints

Complaints must be submitted within 2 years of the purchase date. Complaints submitted after this period may not be accepted.


§9 Governing Law and Jurisdiction

9.1 Applicable Law

These Terms of Service and all Contracts formed through our Website are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law principles. The application of the UN Convention on Contracts for the International Sale of Goods (CISG) is explicitly excluded.

9.2 Consumer Dispute Resolution

For Consumers: If you are a Consumer, the following provisions apply:

  • You may bring legal proceedings in the courts of your own country
  • Alternatively, you may bring proceedings in Polish courts in Płock (the location of our registered office)
  • Consumer protection laws in your country of residence may provide additional rights
  • You have the right to use the EU Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) before pursuing court proceedings

For Businesses: If you are not a Consumer, any disputes shall be resolved exclusively in the courts of Poland and are subject to Polish law and procedure.

9.3 Legal Proceedings

Any legal action or claim arising out of or relating to these Terms or your use of the Website must be commenced within 2 years of the date the cause of action accrues, or such action will be barred.


§10 Intellectual Property Rights

10.1 Content Ownership

All content on the Website—including text, images, logos, product descriptions, designs, and layout—is the intellectual property of the Store or its licensors. You do not acquire any ownership rights by accessing or using the Website.

10.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to view and use the Website for personal, non-commercial purposes only. You may not:

  • Copy, republish, or redistribute Website content without our written permission
  • Use the Website or its content for commercial purposes
  • Remove or obscure any copyright or proprietary notices
  • Reverse-engineer or attempt to access our systems or databases

"Konzept Zeit," the Store logo, and other brand identifiers are trademarks owned by or licensed to the Store. You may not use these marks without our written permission.


§11 Limitation of Liability

11.1 Exclusion of Liability

TO THE EXTENT PERMITTED BY LAW, THE STORE SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, or consequential damages
  • Loss of profits, revenue, business opportunity, or data
  • Damage to reputation or goodwill
  • Claims arising from use or inability to use the Website or Products

11.2 Liability Cap

EXCEPT AS REQUIRED BY MANDATORY LAW, THE TOTAL LIABILITY OF THE STORE TO YOU FOR ANY CLAIM ARISING OUT OF THESE TERMS, THE WEBSITE, OR YOUR PURCHASE SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE PRODUCT IN QUESTION.

11.3 Exceptions

These limitations do not apply to:

  • Death or personal injury caused by our negligence
  • Product liability claims
  • Fraudulent misrepresentation
  • Any liability that cannot be limited under applicable law

§12 Final Provisions

12.1 Entire Agreement

These Terms of Service, together with our Privacy Policy and any other terms posted on our Website, constitute the entire agreement between you and the Store regarding the purchase of Products and use of the Website. They supersede all prior negotiations, representations, and agreements, whether written or oral.

12.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be severed, and the remaining provisions shall remain in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.

12.3 Waiver

The failure of the Store to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. No waiver is valid unless in writing and signed by both parties.

12.4 Assignment

You may not assign, transfer, or delegate your rights or obligations under these Terms without the Store's prior written consent. Any attempted assignment in violation of this provision is void. The Store may assign its rights and obligations at any time without notice to you.

12.5 Amendments

The Store reserves the right to amend these Terms at any time. Amendments will be posted on this page with an updated "Last Updated" date. Your continued use of the Website after posting of amendments constitutes your acceptance of the amended Terms.

12.6 Survival

The following provisions survive termination of the Contract: Warranty Disclaimer, Limitation of Liability, Governing Law, and Intellectual Property Rights.

12.10 Force Majeure

Neither party shall be liable for failure or delay in performing obligations under these Terms if such failure or delay is caused by events beyond reasonable control ("Force Majeure"), including but not limited to:

  • Natural disasters, pandemics, or epidemics
  • War, terrorism, or civil unrest
  • Government action or regulation
  • Strikes, labor disputes, or supply chain disruptions
  • Internet or telecommunications failures

The affected party must provide prompt notice and use reasonable efforts to mitigate the impact.

12.11 Entire Agreement

These Terms constitute the complete and exclusive statement of the agreement between you and the Store regarding the subject matter and supersede all prior negotiations, representations, and agreements.
